Deliberate Indifference reference:
Selecting the approach to be taken to training is a major managerial responsibility. Time, cost, instructional requirements, and available qualified instructors are all factors to be considered. So is litigation. “Failure to train” liability lawsuits, which allege that there was a “deliberate indifference” to proper training, are a real risk to criminal justice agencies, and both police and corrections agencies have found themselves in court to answer for their training failures (Ross, 2000, pp. 330–331). The absence of training in key performance areas—and incorrect or inadequate training in those areas—often will be cited to demonstrate an agency’s negligence in such lawsuits.
