Impeachment of Former President Trump

    On January 6, 2021, thousands of pro-President Donald Trump protesters, some armed, stormed the United States Capital while the United States Congress was meeting to affirm President-elect Joseph Biden’s victory in the 2020 Presidential election. Four deaths ultimately resulted from the incident. On January 13, 2021, the United States House of Representatives impeached President Trump for allegedly inciting the violent insurrection against the United States government, following the attacks on the United States Capitol on January 6, 2021. The single article of impeachment against President Trump charged him with “high crimes and misdemeanors” for allegedly inciting the protestors that assaulted the United States Capitol. The assignment requires you to determine the following: (a) whether the impeachment of Former Presidential Trump was constitutional: and (b) regardless of whether the impeachment of Former President Trump was constitutional, was Former President Trump guilty of “high crimes and misdemeanors” for allegedly inciting the protesters that assaulted the United States Capitol, and, if so, what would be the punishment for doing so. The answer to the assignment shall: (a) be a minimum of approximately 4-6 pages, typed, double-spaced, in 12-point font, with 1" margins; and (b) set forth (i) a brief factual background of the matter; (ii) the issue(s) to be decided in the matter (incorporate cause(s) of action); (iii) the decision ultimately reached in the matter; and (iv) the rationale for the decision (incorporate sources of law relevant and applicable to the issues).
