Order Description
Roman, a keen football supporter, made his will last year, naming Gabby as the executrix.
Clause 1 of the will stated: “I fully hope and firmly expect that Gabby will pay income or capital from the £1,000,000 in my HSBC bank account to those faithful followers of the beautiful game as she shall from time to time in her absolute discretion think fit”.
Clause 2 of the will stated: “One of my collection of signed Premier League football shirts to Abigail, with the remaining shirts to go to Coleen.”
The final clause of the will stated: “The residue of my estate to the charity ‘Russia Reconstruction’ absolutely”.
Two weeks ago Roman told Gabby that he wanted to set up a trust for his nephew Ivan with the subject matter of his shares in Footballiski Ltd. Roman handed Gabby a stock transfer form for the shares in Footballiski Ltd along with the share certificates.
Unfortunately, over the last few days Roman started to feel very unwell, and was admitted to hospital with suspected Avian Flu. He called his good friend Tony over to the hospital and told him: “I do not think I have long to go, I want you to have my gold watch, which you can find in my safety deposit box”. Roman then gave Tony the key to the safety deposit box.
Roman died two days ago. Prior to the death Gabby had tried to register herself as trustee of the shares at Footballiski Ltd, but the company refused to register the share transfer. Abigail and Coleen are having a big argument over which shirt Abigail can have. Tony, together with Gabby, have looked inside the safety deposit box and found a gold watch as well as a cheque for £50,000 made payable to Tony. In addition, the England Football Team Fan Club has applied to Gabby to provide them with capital for travel expenses for away matches for 2018. Gabby has told them that she will not give them any money because she supports Scotland.
Advise Gabby.
